1. DESCRIPTION OF THE SITE. 

The website operated under the control http://www.morrisyorkco.com (hereinafter, the "Website") consists of various web pages operated by MORRIS YORK, whose data are recorded in the last section of this document ( hereinafter "MORRIS YORK"). For the purposes of these conditions of use, any user of the Web Site (including you.), Will be called "User". Through the Web site, MORRIS YORK makes available to the User materials which include messages, graphics, pictures, sound files and / or images, photographs and in general, different types of information and content related to the activities MORRIS and purposes YORK (hereinafter, the "Content") in accordance with the terms and conditions described below.


2. CONDITIONS OF ACCESS AND USE OF THE WEBSITE

Access to the Web Site and the Content and its use are subject to the conditions of use (hereinafter "Terms of Use"). This obligation shall remain in force even after the termination of Morris YORK User or use the Website. The User agrees to defend, indemnify and hold harmless MORRIS YORK against any claims or actions of any kind, and any costs and expenses (including, without limitation, attorneys' fees) arising out of or resulting from the violation by User of the Terms of Use, the law or the rights of others. This obligation shall remain in force even after the termination of Morris YORK User or use the Website.


8. DISCLAIMER OF WARRANTIES AND LIABILITY FOR MORRIS YORK

MORRIS YORK not guarantee the truthfulness, accuracy, completeness, usefulness, suitability, reliability, availability, timeliness, legality, absence of virus or other harmful elements in the Web Site or the Content. The User acknowledges and accepts that the use of the Website and the Content is under their sole responsibility. MORRIS YORK has taken the appropriate protective measures, but does not guarantee the privacy and safety of use of the Website and in particular, not be liable for any damages resulting from the loss or disclosure of information that may occur during the use of the Website or the Content. MORRIS YORK not guarantee the availability and continuity of access to the Website or the Content at any time. MORRIS YORK is not liable for damages of any nature arising directly or indirectly access and use the Web Site or the Content, or delay or inability to use the Content. If the User is dissatisfied with any part of the Website or the Content or any of these Terms of Use, the only and exclusive remedy is to discontinue using the Website. The Website may include links to other websites for mere convenience of the users, whose content and opinions can not be held responsible MORRIS YORK.


9. TERM AND TERMINATION
 

Access to the Web Site and the Content is provided in principle for an unlimited duration. However, MORRIS YORK may terminate or suspend the possibility to access the Web Site or the Content at any time. Whenever reasonably possible, prior notice MORRIS YORK through the Web Site, of said termination or suspension.


10. APPLICABLE LAW AND JURISDICTION

These Terms of Use are governed by Spanish law. If be declared void or unenforceable any provision of these Terms of Use (including, among others, the warranty disclaimers and liability limitations set forth above), the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that can meet more rigorously the intent of the original provision. The remaining provisions of these Terms of Use shall remain in force in its terms.

12. GENERAL INFORMATION

For the purposes of Article 10 of Law 34/2002, of July 11, services of the information society and electronic commerce, it is noted that MORRIS YORK is a Spanish company based in Barcelona.

13. RETURN AND RIGHT OF WITHDRAWAL 

 

Return due to manufacturing defect.

 The User can return any factory-defective product to MORRIS YORK without any cost. Considering the nature of the contracted product, the User will have the period of one month from the moment product nonconformity is detected to notify MORRIS YORK. Any damages or losses shall be borne by the User if User fails to notify within the aforementioned period.

The User shall be exempted of any additional costs with their return of the products presenting manufacturing defects.

The User must contact MORRIS YORK within the given period of one month in order to formally return the product. User shall therefore send an email to info@morrisyorkco.com indicating the product(s) being returned, attaching a photograph and a detailed list of the manifested defects.

Once MORRIS YORK has received the User’s communication it will reply within 3 to 5 days if the product’s return is considered valid. In the event of an approved return, MORRIS YORK shall inform the User how the defective product will be collected, or sent to its offices/stores.

Each product being returned must be without use and with all of its tags, labels, packaging, and where warranted, the original documentation and accessories supplied with the product. MORRIS YORK reserves the right to reject the return if User fails to follow these requisites.

Once the product has been received and the defects confirmed, MORRIS YORK shall allow the User to replace the product for another of identical features, save where such option is objectively impossible or incommensurate.

In the event of shortage in stock preventing the replacement with an identical product, User may choose to withdraw from the contract (i.e. receive the reimbursement of payments made), or voluntarily choose and request another model.

Delivery of a product of identical features, or a new, corresponding model chosen by the User, shall take place in the next 3 to 5 workdays from the date MORRIS YORK confirms the defective product’s replacement, or shipment of the new model.

The User shall be exempted of any extra costs with the replacement, shipment of the new model, or withdrawing from the contract.

MORRIS YORK shall reimburse the entirety of payment(s) made by the User who purchased the defective product (including shipping costs) if the User decides to withdraw from the contract.

MORRIS YORK informs Users that the reimbursement term for amounts paid shall depend on the form of payment adopted by User to purchase the product.


Withdrawal

In case the User is not satisfied with the products received in the User’s order, the User has fourteen (14) calendar days, pursuant to the General Consumer and User Protection Law, to return the order in its entirety, or may opt to return any of the products that accompany the order in its entirety, entirely without any penalties, and without the need to present justification.

However, the User must take charge of the direct cost of returning the products ordered in their entirety, or in part, to MORRIS YORK.

To formalize the return, the User must inform MORRIS YORK through the email info@morrisyorkco.com, upon receiving the email, MORRIS YORK shall instruct how to send the order to its offices or stores.

MORRIS YORK is not liable for the shipping company User hires to return the order. In this regard, MORRIS YORK recommends that the User require the courier or shipping company to provide proof of delivery once the product is delivered at MORRIS YORK offices, allowing for User to receive evidence that the product was properly delivered to MORRIS YORK. MORRIS YORK shall not be held liable for the address to which User returns the order. In the case of Europe, it should always be returned to our office.

The costs to return the order (e.g. courier/shipping company costs) shall be directly borne by the User.

The product being returned must be without use and with all of its tags, labels, packaging, and where warranted, the original documentation and accessories supplied with the product. User agrees that the product may suffer depreciation or that MORRIS YORK may reject its return if User fails to proceed as instructed, or if the product suffers any damage.

Once MORRIS YORK verifies that the order is in good condition, MORRIS YORK shall refund the full amount paid by the User.

If the User decides to return the order in its entirety, MORRIS YORK shall refund the User the entirety of amounts paid by the User ( not including shipping expenses).

MORRIS YORK shall not refund shipping expenses paid by User for the entirety of the order if the User only wishes to return one or some of the products of the order.

MORRIS YORK informs Users that the reimbursement term for amounts paid shall depend on the form of payment adopted by User to purchase the product.

In any case, MORRIS YORK shall refund the amounts paid as soon as possible, within the term of 14 calendar days, from date the User communicates the decision to withdraw from the contract.

 

Product Change Policy

MORRIS YORK shall not change a product purchased by the User for another offered on the Website.

Should the User wish to change a product, he/she shall claim the right to withdraw from the [purchase] contract thereof, and then proceed to purchase the desired product.


15. COOKIES POLICY

This Cookies Policy forms part of the Privacy Policy for the website hosted under the domain name www.morrisyorkco.com (the “Web Site”) and under any of the subdomains thereof or dependent web pages. We use cookies to improve our services.
